AllStarBids Seller Agreement

Welcome to AllStarBids (allstarbids.com). This Seller Agreement (“Agreement”) governs your listing, offering, and sale of collectibles, trading cards, memorabilia, and related items through the AllStarBids platform (“Services”). By using our platform to sell items, you agree to be bound by this Agreement.

If you do not agree to these terms, you may not list or sell items on AllStarBids.

1. About AllStarBids

AllStarBids is an online marketplace and service provider, facilitating auctions, offers, and fixed-price sales between independent sellers and buyers.

Important: AllStarBids is not the owner of listed items unless explicitly stated. The platform acts solely as a neutral intermediary.

2. Seller Eligibility

To sell on AllStarBids, you must:

• Be at least 18 years old

• Be legally capable of entering binding contracts

• Provide accurate and complete account information

• Maintain security of login credentials

AllStarBids reserves the right to approve, suspend, or terminate accounts at its sole discretion.

3. Seller Responsibilities

Sellers agree to:

• Provide truthful, accurate, and complete item descriptions

• Disclose all known defects, provenance, and authenticity details

• Ship items promptly, securely, and within 48 hours unless otherwise stated

• Ensure lawful ownership and sourcing

• Honor all completed transactions

Misrepresentation, fraud, or intentional misleading activity may result in account termination or legal action.

4. Prohibited Items

Sellers may not list:

• Counterfeit, stolen, or unlawfully obtained items

• Illegal items or restricted materials

• Items violating intellectual property rights

• Weapons, drugs, or hazardous materials (unless expressly approved)

AllStarBids may remove prohibited listings at any time.

5. Listings, Auctions, and Pricing

5.1 Auctions and Fixed-Price Listings

• Items may be offered via auction-style bidding, fixed-price listings, or offers.

• All bids and offers are binding.

• Sellers are responsible for fulfilling all transactions with winning buyers.

5.2 Buy It Now (Optional Feature)

• Allows immediate purchase at a stated price.

• Purchases are binding upon confirmation.

• Availability and pricing may change at AllStarBids’ discretion.

6. Payments, Fees, and Commissions

Sellers agree to pay:

• Seller commissions

• Payment processing fees

• Any other fees disclosed prior to listing or sale

Funds will be released after buyer payment clears, minus applicable fees.
AllStarBids may withhold payment in cases of dispute, fraud, or policy violation.

7. Shipping, Taxes, and Customs

Sellers are responsible for:

• Safe packaging of items

• Providing tracking information

• Insuring high-value items when appropriate

• Compliance with tax, duties, and customs regulations

AllStarBids is not responsible for delays or losses caused by carriers or customs authorities.

8. Item Authenticity and Condition

Sellers warrant that:

• Items are authentic unless clearly stated otherwise

• Descriptions and images accurately reflect condition

AllStarBids does not guarantee grading outcomes, market value, or third-party authentication results.

9. Returns, Refunds, and Disputes

• Sellers must comply with AllStarBids return policies and applicable consumer protection laws.

• Buyers and sellers are encouraged to resolve disputes directly.

• AllStarBids may intervene at its discretion in cases of fraud, misdescription, or shipment discrepancies.

10. Intellectual Property

• Sellers retain ownership of content but grant AllStarBids a non-exclusive, royalty-free license to use listing content for marketing and platform purposes.

• Platform branding, logos, and design elements cannot be used without written consent.

11. Indemnification

Sellers agree to indemnify and hold harmless AllStarBids against claims arising from:

• Listings or sales

• Violation of this Agreement

• Legal or regulatory breaches

12. Limitation of Liability

To the fullest extent permitted by law:

• AllStarBids is not liable for indirect, incidental, or consequential damages

• Not responsible for market fluctuations, lost profits, or buyer actions

• Total liability is limited to fees paid to AllStarBids for the relevant transaction

13. Account Enforcement & Termination

AllStarBids may suspend or terminate accounts for:

• Policy violations

• Fraud, misrepresentation, or misconduct

• Legal or regulatory issues

Termination does not relieve sellers of outstanding obligations.

14. Tax Responsibility

Sellers must:

• Report income from sales

• Maintain records

• Submit required tax documentation

AllStarBids may provide tax forms and reporting as required by law.

15. Governing Law

This Agreement is governed by the laws of the jurisdiction in which AllStarBids is registered, without regard to conflict-of-law principles.

16. Acceptance

By listing items on AllStarBids, you acknowledge that you have read, understood, and agree to be bound by this Seller Agreement.
