This Seller Agreement (“Agreement”) governs the relationship between AllStarBids and any individual or entity (“Seller”) that lists items for sale through the AllStarBids platform.
By listing items, submitting inventory, or participating as a Seller on AllStarBids, you acknowledge that you have read, understood, and agree to be bound by this Agreement, along with all applicable auction rules, policies, and procedures.
To sell on AllStarBids, you must:
Be at least eighteen (18) years of age
Have full legal authority to sell the listed items
Provide accurate account, identity, and payment information
Comply with all applicable local, state, national, and international laws
AllStarBids reserves the right to approve, suspend, restrict, or reject Seller accounts at its sole discretion.
By listing items on AllStarBids, Sellers agree to:
Accurately and honestly describe all listed items along with proper and correct photos of the item
Fully disclose any known defects, damage, or material facts
Advise if the item is graded and at the correct level
Advise if the item is “raw” and be clear and up front about this (seller is not held responsible for any grading done later by the buyer)
Advise if the item is in new, used or open box condition
Ensure lawful ownership and sourcing of all items
Ship sold items promptly and securely as agreed upon with the buyer per the settlement invoice/agreement
Honor all completed auctions and sales
Any misrepresentation, fraud, or deceptive conduct may result in account termination, financial liability, and potential legal action.
Sellers may not list items that include, but are not limited to:
AllStarBids reserves the right to remove prohibited listings at any time without prior notice.
Sellers agree to pay all applicable fees, which may include:
Listing fees (if applicable)
Seller commissions – Currently 9.5%
Payment processing or transaction fees
All fees will be disclosed prior to listing or sale.
AllStarBids reserves the right to update fee structures with reasonable notice.
Once an auction closes, AllStarBids will e-mail both parties (winning bidder and seller) confirmation of successful complete action and a settlement invoice with all required details. This serves as an introduction to both parties by AllStarBids in order for you to complete the transaction.
Winning bidders (buyers) must pay for the remaining balance of the auction item(s) total hammer price within 72 hours of auction completion as per terms of the seller and accepted forms of payment, or risk actions taken upon them per AllStarBids Buyer Agreement.
Seller proceeds are received (less all applicable fees and commissions already paid to AllStarBids) directly from the winning bidder (buyer) of the auction within 72 hours (3 days) of auction close.
Once a seller receives payment, they must ship the item out to the winning bidder within 72 hours (3 days) of payment submission date, or risk actions taken upon them as per AllStarBids Seller Agreement.
Sellers are responsible for:
Shipping the correctly sold item in the auction
Secure and appropriate packaging
Providing valid shipment tracking information
Insuring high-value items when commercially reasonable
Ship sold items promptly and securely as agreed upon with the buyer per the settlement invoice/agreement (general rule-of-thumb and “reasonable expectations” with regard to shipping time is for the selling party to ship within forty-eight (48) hours of sale completion, unless otherwise stated/agreed to with buyer
Failure to ship items on time or improper fulfillment may result in penalties, delayed payments, or account suspension.
AllStarBids in no way can issue a return or refund of a completed auction item.
All disputes related to a transaction must be resolved exclusively between Buyer and Seller, including:
Payment disputes
Shipping delays
Item condition or authenticity concerns
Buyer remorse
Pricing disagreements
Applicable consumer protection and commerce laws
AllStarBids may resolve disputes at its discretion.
Sellers represent and warrant that:
Items are authentic unless clearly disclosed otherwise
Descriptions are truthful and accurate
Images reflect the actual condition of the listed items
False claims or misrepresentation may result in financial liability, account termination, and legal consequences.
Sellers retain ownership of their intellectual property and listing content.
However, Sellers grant AllStarBids a non-exclusive, worldwide, royalty-free license to use, reproduce, and display listing content for platform operations, marketing, and promotional purposes.
Sellers agree to indemnify, defend, and hold harmless AllStarBids from any claims, losses, damages, or liabilities arising from:
Seller listings or transactions
Breach of this Agreement
Violations of applicable laws or third-party rights
AllStarBids may suspend or terminate Seller access for:
Violations of platform policies
Fraud, misconduct, or deceptive practices
Legal or regulatory concerns
Termination does not relieve Sellers of outstanding obligations or liabilities incurred prior to termination.
To the maximum extent permitted by law, AllStarBids shall not be liable for:
Seller losses resulting from Buyer actions or non-performance
Market fluctuations or changes in demand
Lost profits or indirect damages
AllStarBids’ total liability shall not exceed the fees paid by the Seller for the applicable transaction.
Sellers are solely responsible for:
Reporting income derived from sales
Maintaining accurate financial records
Submitting required tax documentation
AllStarBids may issue tax forms or disclosures as required by applicable law.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which AllStarBids is registered, without regard to conflict-of-law principles.
