1. Introduction and Scope

The present Giveaway and Promotional Contest Terms (the “Contest Terms”) govern all giveaways, prize draws, promotional contests, launch promotions, auction-linked promotions, user-registration promotions, loyalty promotions, and similar prize-based promotions conducted, sponsored, administered, or promoted by AllStarBids.com (“AllStarBids,” “we,” “us,” or “our”) through the website located at https://allstarbids.com, including all related pages, subdomains, promotional pop-ups, emails, auction notices, social media posts, and other promotional materials connected with the AllStarBids platform (collectively, the “Platform”).

These Contest Terms apply to each promotion made available by AllStarBids unless a separate written set of official rules is published for a specific promotion. Where a specific promotion includes a promotional notice, pop-up disclosure, email notice, landing-page notice, or other campaign-specific description (each, a “Promotional Notice”), that Promotional Notice shall be read together with these Contest Terms. If a conflict exists between these Contest Terms and the Promotional Notice for a specific promotion, the Promotional Notice shall control solely with respect to the prize description, promotional period, entry method, geographic availability, winner-selection date, prize value, and any promotion-specific eligibility requirement expressly stated therein.

Participation in any AllStarBids giveaway or promotional contest constitutes the participant’s full and unconditional agreement to these Contest Terms, the applicable Promotional Notice, the AllStarBids Terms of Service, the User Agreement, the Privacy Policy, the Cookie Policy, and all other Platform rules incorporated by reference. A person who does not agree with these terms must not enter, participate in, claim, or attempt to claim any prize.

2. Sponsor and Administrator

The sponsor and administrator of each promotion is AllStarBids.com, owned and operated from the Province of Ontario, Canada. Unless expressly stated otherwise in a Promotional Notice, no auction seller, buyer, payment processor, carrier, card manufacturer, trading-card company, grading company, sports league, entertainment company, social media platform, advertising network, or third-party brand is the sponsor, administrator, guarantor, or underwriter of any promotion.

Any reference to a prize brand, trading-card brand, sports team, league, entertainment property, manufacturer, or third-party trademark is made solely for identification of the prize or related product. No such reference shall be construed as an endorsement, sponsorship, authorization, approval, or affiliation unless AllStarBids expressly states otherwise in writing.

3. Applicable Legal Framework

AllStarBids conducts promotions with reference to applicable Canadian law, including the Competition Act, R.S.C. 1985, c. C-34, the Criminal Code, R.S.C. 1985, c. C-46, the Personal Information Protection and Electronic Documents Act, S.C. 2000, c. 5 (“PIPEDA”), Canada’s Anti-Spam Legislation, S.C. 2010, c. 23 (“CASL”), and such provincial, territorial, state, federal, consumer-protection, privacy, advertising, and contest laws as may apply based on the nature of the promotion and the participant’s jurisdiction.

The operation of a promotion in one jurisdiction does not constitute a representation that the same promotion is lawful, available, or unrestricted in every jurisdiction. AllStarBids reserves the right to limit, modify, suspend, or exclude participation from any jurisdiction where the promotion would be prohibited, restricted, subject to registration, subject to bonding, subject to translation requirements, subject to tax reporting, or otherwise burdensome to administer in AllStarBids’ reasonable judgment.

4. No Purchase Necessary

No purchase, bid, auction win, payment, commission charge, seller listing, or other monetary transaction is required to enter or win any AllStarBids promotion unless a purchase-based or auction-linked mechanism is expressly permitted by applicable law and accompanied by an alternative method of entry. Where a promotion is connected to registration, auction participation, an auction win, or a minimum transaction threshold, AllStarBids shall provide a no-purchase method of entry that affords eligible participants a substantially equivalent opportunity to enter the applicable promotion.

For auction-linked promotions, including promotions described as available to one random winning bidder, one registered user, or one user associated with an auction cycle, eligible persons may enter without purchase by following the alternative entry instructions stated in the applicable Promotional Notice. Unless the Promotional Notice provides otherwise, a no-purchase entry may be submitted by emailing support@allstarbids.com with the subject line “Giveaway Entry,” and by including the participant’s full name, AllStarBids username (if any), country, province or state of residence, email address, telephone number, and the name of the applicable promotion.

No-purchase entries must be received during the promotional period stated in the Promotional Notice. Late, incomplete, automated, bulk, illegible, misdirected, or fraudulent entries may be disqualified.

5. Skill-Testing Question for Canadian Winners

Before being declared an official winner, a selected entrant who is resident in Canada must correctly answer, without mechanical, electronic, or other assistance, a time-limited mathematical skill-testing question administered by AllStarBids or its designated representative. AllStarBids may require the selected entrant to complete the question by email, telephone, online form, or signed declaration.

Failure to answer the skill-testing question correctly within the time and manner specified by AllStarBids shall result in disqualification, forfeiture of the prize, and selection of an alternate entrant, provided that AllStarBids is able to select an alternate entrant within a commercially reasonable period. No prize shall be awarded to a Canadian resident until the skill-testing question requirement has been satisfied.

6. Eligibility

Unless the applicable Promotional Notice states otherwise, promotions are open only to individuals who satisfy all of the following requirements at the time of entry and at the time of prize award:

Minimum Age: The participant must be at least eighteen (18) years of age or the age of majority in the participant’s jurisdiction of residence, whichever is higher.

Legal Capacity: The participant must possess the legal capacity to enter into binding terms and to comply with all obligations arising under these Contest Terms.

Account Status: Where the promotion requires an AllStarBids account, the participant must maintain an account in good standing, with accurate registration information and no active suspension, restriction, fraud review, payment default, chargeback dispute, or unresolved enforcement action.

Jurisdictional Availability: The participant must reside in a jurisdiction where participation is lawful and where AllStarBids has not excluded or restricted the promotion.

Compliance Record: The participant must not have engaged in fraudulent, abusive, manipulative, or unlawful conduct on the Platform, including shill bidding, payment abuse, false account creation, bid manipulation, seller fraud, buyer fraud, counterfeit activity, chargeback abuse, or misuse of another person’s personal information.

Employees, contractors, officers, directors, agents, representatives, and immediate family members of AllStarBids, together with persons living in the same household as such individuals, are ineligible to participate unless the Promotional Notice expressly states otherwise.

7. Promotional Period

Each promotion begins and ends on the dates and times stated in the applicable Promotional Notice. All times shall be interpreted according to Eastern Time in Ontario, Canada, unless the Promotional Notice specifies a different time zone.

AllStarBids’ computer systems and records shall serve as the official timekeeping mechanism for purposes of determining whether an entry was received within the applicable promotional period. Proof of transmission, sending, posting, or submission does not constitute proof of receipt by AllStarBids.

8. Types of Promotions Covered

These Contest Terms are intended to cover, without limitation, the following categories of AllStarBids promotions:

Launch Registration Giveaway: A promotion in which eligible persons who register for an AllStarBids account during a specified launch period may be entered for a chance to win one stated prize, subject to any no-purchase entry procedure described in the Promotional Notice.

Auction-Linked Giveaway: A promotion in which eligible persons associated with a specific auction cycle, such as winning bidders or qualifying users, may be entered for a chance to win one stated prize, provided that a no-purchase entry method is made available where required by law.

Minimum-Threshold Giveaway: A promotion in which eligibility may be connected to an auction lot, bid, transaction, or stated value threshold, such as an auction item with a hammer price exceeding a specified amount, provided that the Promotional Notice identifies the applicable threshold and a no-purchase entry method is made available where required by law.

User-Based Promotional Draw: A promotion in which one or more eligible registered users are selected at random from eligible entries received during the promotional period.

Future Promotional Events: Any later prize-based promotion, prize draw, giveaway, or comparable promotional event that AllStarBids elects to conduct, unless AllStarBids publishes separate official rules for that specific event.

9. Entry Limits

Unless the applicable Promotional Notice provides otherwise, each eligible person may receive no more than one (1) entry per promotion. Multiple accounts, duplicate entries, automated entries, entries submitted through scripts, entries submitted through bots, or entries submitted under false, incomplete, misleading, or third-party information are prohibited.

AllStarBids may aggregate, reject, or disqualify entries that appear to have been submitted by the same person using multiple accounts, aliases, email addresses, devices, addresses, payment instruments, or other identifying information. A participant may not transfer, sell, assign, or exchange an entry.

10. Prize Description and Approximate Retail Value

The prize or prizes available for a promotion, the number of prizes, the approximate retail value of each prize, and any material prize conditions shall be disclosed in the applicable Promotional Notice. Unless expressly stated otherwise, each promotion shall award only the prize specifically described in the Promotional Notice.

Prize descriptions may refer to products such as sealed trading-card boxes, collectible items, memorabilia, or comparable goods. Where a prize consists of trading cards, sealed boxes, collectibles, memorabilia, or similar items, AllStarBids makes no representation or warranty regarding future market value, grading outcome, resale value, scarcity, investment potential, player performance, team performance, print quality, factory collation, condition variations, or the contents of sealed products.

The approximate retail value of a prize is determined in good faith as of the time the Promotional Notice is prepared. Market fluctuations, collectible-market volatility, retail availability, exchange-rate movement, shipping cost variations, or later price changes shall not entitle any winner to a substitution, cash adjustment, credit, additional prize, or compensation.

11. Odds of Winning

The odds of winning depend on the number of eligible entries received during the applicable promotional period and, where applicable, the number of eligible entries allocated to a given geographic area, auction cycle, account category, or promotional pool. AllStarBids shall not represent that odds are fixed unless the total number of eligible entries is known and stated.

No participant is guaranteed to win. Participation in prior auctions, frequent bidding, high-value bidding, seller activity, account tenure, or prior use of the Platform does not improve the odds of winning unless the Promotional Notice expressly states otherwise and such structure is lawful in the relevant jurisdiction.

12. Winner Selection

Unless the Promotional Notice states a different lawful method, potential winners will be selected by random draw from all eligible entries received during the applicable promotional period. The draw shall be conducted on or around the date stated in the Promotional Notice, or, if no date is stated, within a commercially reasonable period after the close of the promotional period.

AllStarBids may conduct the draw manually, through a random-number generator, through a spreadsheet-based randomization method, through an internal draw procedure, or through a third-party tool selected in good faith. AllStarBids’ records regarding entries, eligibility, draw procedures, and winner selection shall be final and binding, except where prohibited by applicable law.

13. Winner Notification and Claim Procedure

A selected entrant will be notified using the email address, account message function, telephone number, or other contact information associated with the entrant’s AllStarBids account or entry. The selected entrant must respond within the timeframe stated in the notification. If no timeframe is stated, the selected entrant must respond within seventy-two (72) hours after AllStarBids sends the notification.

Before being declared an official winner, a selected entrant may be required to complete, sign, and return eligibility documentation, a declaration and release, a publicity consent, tax documentation, identity-confirmation materials, shipping information, and any other documentation reasonably required by AllStarBids. A Canadian selected entrant must also correctly answer the skill-testing question described in Section 5.

Failure to respond within the required timeframe, failure to provide required documentation, failure to satisfy eligibility requirements, failure to answer the skill-testing question correctly, refusal to accept the prize, or return of a notification as undeliverable may result in disqualification and selection of an alternate entrant.

14. Prize Award and Delivery

AllStarBids shall use commercially reasonable efforts to arrange shipment or delivery of the prize to the confirmed winner. Unless the Promotional Notice states otherwise, standard shipping costs for the prize will be paid by AllStarBids. Any expedited shipping, special handling, import duty, customs brokerage, tariff, tax, remote-area surcharge, carrier fee, insurance fee, or other charge not expressly assumed by AllStarBids shall be the sole responsibility of the winner.

Where a prize is shipped internationally, the winner is solely responsible for ensuring that the prize may be lawfully imported into the winner’s jurisdiction. AllStarBids shall not be liable for customs delays, import refusal, seizure, inspection, regulatory restriction, taxes, duties, brokerage fees, lost shipments, damaged shipments, stolen shipments, carrier error, or delivery failure after the prize has been tendered to the carrier.

AllStarBids may require a confirmed winner to provide a complete and accurate shipping address within a specified period. If the winner provides inaccurate, incomplete, or undeliverable shipping information, the prize may be forfeited.

15. No Cash Alternative and Prize Substitution

Prizes are non-transferable, non-assignable, and not redeemable for cash, credit, account credit, auction credit, commission reduction, substitute merchandise, or any other consideration, except at AllStarBids’ sole discretion.

AllStarBids reserves the right to substitute a prize, or any component thereof, with a prize of equal or greater approximate retail value if the advertised prize becomes unavailable, delayed, damaged, discontinued, restricted, impracticable to ship, or otherwise unsuitable for award. No substitution shall give rise to any liability to a participant or winner.

16. Taxes and Reporting

All federal, provincial, territorial, state, local, foreign, and other taxes, duties, assessments, charges, or reporting obligations arising from acceptance or use of a prize are the sole responsibility of the winner. AllStarBids may issue tax documentation, request taxpayer-identification information, or report prize awards to tax authorities where required by applicable law.

A winner’s refusal or failure to provide required tax documentation may result in forfeiture of the prize. AllStarBids does not provide tax advice and makes no representation regarding the tax consequences of accepting any prize.

17. Disqualification and Enforcement

AllStarBids reserves the right, in its sole discretion, to disqualify any participant or selected entrant who:

False Information: Provides false, incomplete, inaccurate, misleading, or unverifiable information.

Account Misuse: Enters through multiple accounts, third-party accounts, fabricated accounts, automated methods, or identity-misuse practices.

Platform Misconduct: Violates the Terms of Service, User Agreement, Buyer Agreement, Seller Agreement, Settlement Agreement and Policy, or any other Platform rule.

Fraudulent Conduct: Engages in scam activity, seller fraud, buyer fraud, payment fraud, chargeback abuse, counterfeit activity, shill bidding, bid manipulation, collusion, or other dishonest conduct.

Technical Interference: Attempts to interfere with the operation, security, fairness, or integrity of the promotion, the Platform, or any related system.

Abusive Behaviour: Harasses, threatens, abuses, defames, or attempts to intimidate any participant, winner, Seller, Buyer, AllStarBids representative, or third party.

Disqualification from a promotion does not limit any other right or remedy available to AllStarBids, including account suspension, permanent termination, cancellation of bids, removal of listings, withholding of promotional eligibility, reporting to payment processors, reporting to law enforcement, and pursuit of civil remedies.

18. Fraud Prevention and Disclosure to Authorities

Where AllStarBids reasonably believes that a participant, selected entrant, winner, Buyer, Seller, or other User has engaged in fraud, attempted fraud, scam activity, identity misuse, payment abuse, counterfeit activity, theft, chargeback abuse, unlawful conduct, or conduct that threatens the safety or integrity of the Platform, AllStarBids may preserve, review, use, and disclose relevant account information, transaction records, communications, shipping information, payment-related records, IP logs, device information, and other relevant evidence to law enforcement authorities, regulatory bodies, payment processors, fraud-prevention services, carriers, affected Users, legal counsel, or other competent recipients where permitted or required by applicable law.

Such disclosure may be made without prior notice to the affected User where notice would compromise an investigation, expose other Users to risk, interfere with fraud prevention, conflict with legal obligations, or otherwise be inappropriate under the circumstances.

19. Publicity Consent

Except where prohibited by applicable law, acceptance of a prize constitutes the winner’s consent for AllStarBids to use the winner’s first name, username, city, province or state, country, prize information, likeness where voluntarily provided, and general winner status for reasonable promotional, advertising, announcement, social media, and Platform-related purposes, without additional compensation or further approval.

AllStarBids may publish winner information in a limited form, such as “winner username,” “first name and province/state,” or comparable non-sensitive identifier. AllStarBids will not publicly disclose a winner’s full residential address, payment information, government identification, or sensitive personal information as part of winner announcements.

20. Privacy and Personal Information

Personal information collected in connection with a promotion will be processed in accordance with the AllStarBids Privacy Policy and applicable privacy law, including PIPEDA, GDPR, UK GDPR, and CCPA/CPRA where applicable. Personal information may be used to administer the promotion, verify eligibility, contact selected entrants, award prizes, conduct fraud-prevention checks, comply with legal obligations, maintain records, respond to regulatory requests, and protect the rights, safety, and integrity of AllStarBids and its Users.

Where a participant provides consent to receive marketing communications, AllStarBids may send commercial electronic messages in accordance with CASL and other applicable electronic-communications laws. Consent to marketing communications is not required to enter or win a promotion unless expressly permitted by applicable law and disclosed in the Promotional Notice.

21. Technical Errors and Platform Interruptions

AllStarBids is not responsible for lost, late, incomplete, corrupted, misdirected, delayed, undelivered, or deleted entries, nor for technical, hardware, software, server, network, browser, device, internet-service, telecommunications, or email failures affecting participation. Entries that are tampered with, unreadable, incomplete, mechanically reproduced, generated by automated means, or otherwise inconsistent with these Contest Terms may be void.

If a promotion cannot be conducted as planned due to fraud, technical failure, unauthorized intervention, platform outage, security incident, legal restriction, force majeure event, or any other cause beyond AllStarBids’ reasonable control, AllStarBids may cancel, suspend, modify, or terminate the promotion and, where fair and practicable, select a winner from eligible entries received before the affected event.

22. Release of Liability

By participating in a promotion, each participant releases AllStarBids, its officers, directors, employees, contractors, agents, affiliates, service providers, advertising partners, payment processors, and representatives from any and all claims, demands, actions, liabilities, losses, damages, costs, and expenses arising out of or related to participation in the promotion, acceptance or use of a prize, inability to use a prize, prize delivery, prize defects, customs issues, tax consequences, shipping issues, technical failures, disqualification, or any promotional announcement.

Nothing in these Contest Terms shall exclude liability that cannot lawfully be excluded under applicable law.

23. Indemnification

Each participant agrees to indemnify, defend, and hold harmless AllStarBids and its officers, directors, employees, contractors, agents, affiliates, and representatives from and against all claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to the participant’s breach of these Contest Terms, violation of applicable law, fraudulent conduct, misuse of the Platform, submission of false information, infringement of third-party rights, or misuse of a prize.

24. Third-Party Platforms and Promotional Channels

Where a promotion is advertised or communicated through Instagram, Facebook, X, TikTok, YouTube, Google, email, or any other third-party platform, such third-party platform is not the sponsor, administrator, or guarantor of the promotion unless expressly stated by AllStarBids in writing. The participant releases such third-party platforms from all claims arising out of or related to the promotion.

Participation through a third-party platform may also be subject to that platform’s own terms, rules, and privacy practices. AllStarBids is not responsible for account restrictions, platform outages, content removals, advertising review decisions, or other actions taken by a third-party platform.

25. Modification, Suspension, and Cancellation

AllStarBids reserves the right to modify, suspend, extend, cancel, or terminate any promotion where required by law, where administration becomes impracticable, where fraud or abuse is suspected, where the prize becomes unavailable, where technical issues impair fairness, or where continuation would expose AllStarBids, Users, or participants to material legal, operational, reputational, or financial risk.

No participant shall have any vested right to continuation of a promotion. Where a promotion is cancelled before prize award, AllStarBids may, in its sole discretion, award the prize from among eligible entries received before cancellation, substitute a comparable promotional opportunity, or terminate the promotion without awarding a prize where lawful and reasonable under the circumstances.

26. Void Where Prohibited

All promotions are void where prohibited, restricted, or otherwise unlawful. AllStarBids may restrict participation in any province, territory, state, country, or other jurisdiction where the promotion would require registration, bonding, translation, licensing, tax withholding, additional filings, governmental approval, or other procedures that AllStarBids elects not to undertake.

Participants are responsible for ensuring that entry into a promotion and acceptance of any prize are lawful in their jurisdiction of residence. AllStarBids makes no representation that any promotion is available or lawful in every jurisdiction.

27. Governing Law and Dispute Resolution

These Contest Terms, and any dispute arising out of or relating to any AllStarBids promotion, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Prior to commencing any formal proceeding, a participant must first submit written notice of the dispute to AllStarBids at support@allstarbids.com, describing the nature of the claim, the promotion involved, the relief requested, and all supporting facts. The participant and AllStarBids shall engage in good-faith informal resolution for a period of no fewer than thirty (30) days.

If the dispute remains unresolved, the dispute shall be resolved in accordance with the arbitration and dispute-resolution provisions contained in the AllStarBids Terms of Service. To the fullest extent permitted by law, all disputes shall be brought only in an individual capacity, and no participant may participate in a class action, class arbitration, representative proceeding, or collective proceeding against AllStarBids.

28. Severability

If any provision of these Contest Terms is determined by a court, arbitrator, or competent authority to be invalid, unlawful, or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions. The affected provision shall be modified to the minimum extent necessary to render it valid and enforceable, or, where modification is not possible, severed from these Contest Terms.

29. Entire Agreement

These Contest Terms, together with the applicable Promotional Notice, the Terms of Service, the User Agreement, the Privacy Policy, the Cookie Policy, and any other Platform rule incorporated by reference, constitute the entire agreement between the participant and AllStarBids with respect to the applicable promotion. No oral statement, informal message, social media comment, customer-support response, or promotional description shall modify these Contest Terms unless expressly incorporated into a written Promotional Notice issued by AllStarBids.

31. Acknowledgment

By entering, participating in, or attempting to claim a prize in any AllStarBids giveaway or promotional contest, the participant confirms that the participant has read these Giveaway and Promotional Contest Terms in their entirety, understands their legal effect, satisfies the applicable eligibility requirements, and agrees to be bound by all terms, conditions, limitations, releases, and obligations set forth herein.
