Terms of Service

AllStarBids Terms of Service & Transaction Framework

These Terms of Service (“Terms”) govern the use of the AllStarBids website, also known as allstarbids.com, including all related tools, features, and services (collectively, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms.

These Terms incorporate by reference the following policies, which together govern all platform activity:

  • User Agreement

  • Buyer Agreement

  • Seller Agreement

  • Settlement Agreement

1. Nature of the Service

AllStarBids is a technology platform only.

AllStarBids acts solely as a neutral intermediary that facilitates online auctions and transactions between independent third-party buyers and sellers.

AllStarBids:

  • Does not own, buy, sell, broker, consign, authenticate, or warehouse items

  • Is not a dealer, reseller, marketplace operator, or auction house

  • Does not take title to or possession of any listed or sold items

  • Does not guarantee item descriptions, condition, authenticity, grading, or value

All transactions occur directly between the Seller and the winning Buyer.

2. Seller Responsibilities

Sellers are solely responsible for:

  • Providing accurate, complete, and truthful item descriptions

  • Disclosing condition, defects, provenance, and authenticity details

  • Packaging, shipping, insuring, and delivering items

  • Complying with all applicable laws and regulations

  • Handling all buyer communications, disputes, refunds, and returns

By listing an item, Sellers represent and warrant that:

  • They have legal ownership or authority to sell the item

  • The item is not counterfeit, stolen, or unlawfully obtained

  • Listings are not misleading or deceptive

3. Buyer Responsibilities

Buyers acknowledge and agree that:

  • All bids constitute binding legal offers

  • Items are purchased “as-is” and “as-described” by the Seller

  • AllStarBids does not inspect, authenticate, or verify items

  • Due diligence is the Buyer’s responsibility prior to bidding

4. No Returns or Refunds by AllStarBids

AllStarBids does not handle:

  • Returns

  • Refunds

  • Exchanges

  • Chargebacks

Any return or refund request must be resolved directly between Buyer and Seller.

AllStarBids is not a party to the sale contract formed between Buyer and Seller.

5. Dispute Resolution Between Buyer and Seller

All disputes related to a transaction must be resolved exclusively between Buyer and Seller, including:

  • Payment disputes

  • Shipping delays

  • Item condition or authenticity concerns

  • Buyer remorse

  • Pricing disagreements

6. Limited Circumstances for AllStarBids Review

AllStarBids may review a transaction only after completion, and only where documented proof is provided showing one or more of the following:

  • Material Misdescription – Item materially differs from listing

  • Damage in Transit – Carrier-documented shipping damage

  • Proven Inauthenticity – Verified third-party evidence

  • Incorrect Item Shipped – Item received differs from listing

  • Item Returned Is Not Original – Returned item does not match original

7. Scope of AllStarBids Involvement

If a claim qualifies for review, AllStarBids may:

  • Request documentation from both parties

  • Temporarily restrict Buyer or Seller accounts

  • Facilitate communication

AllStarBids does not guarantee any resolution, refund, or outcome and retains sole discretion.

8. Limitation of Liability

To the fullest extent permitted by law:

  • AllStarBids is not liable for direct or indirect damages

  • Not responsible for fraud, misrepresentation, shipping errors, or Seller conduct

  • Total liability shall not exceed fees paid to AllStarBids for the transaction

9. Indemnification

Users agree to indemnify and hold harmless AllStarBids, its officers, employees, and agents from any claims arising from:

  • Use of the Site

  • Participation in transactions

  • Breach of these Terms

10. Account Enforcement & Termination

AllStarBids reserves the right to:

  • Suspend or terminate accounts

  • Remove listings

  • Restrict platform access

This may occur with or without notice for policy violations or unlawful activity.

11. Accountability & Platform Conduct

Platform Role

AllStarBids is a facilitator only and is not a buyer or seller unless explicitly stated.

Account Responsibilities

Users must:

  • Maintain accurate account information

  • Protect login credentials

  • Accept responsibility for all account activity

Prohibited Conduct

Including but not limited to:

  • Fraud or deception

  • Circumventing fees

  • Market manipulation

  • Fake or shill bidding

12. Trust & Safety Program

AllStarBids enforces:

  • Identity verification

  • Seller vetting

  • Fraud detection and monitoring

  • Listing moderation

Users may report fraud, misrepresentation, counterfeits, or abuse.
Reports are reviewed by trained compliance staff.

13. Strike Policy & Enforcement

2-Strike Hybrid Rule

  • Strike 1: Written warning

  • Strike 2: Permanent account termination

Severe Violations (Immediate Ban)

  • Counterfeit sales

  • Intentional misrepresentation

  • Payment or chargeback fraud

  • Auction manipulation

  • Harassment or threats

No appeal is guaranteed.

14. Authenticity, Verification & Security

AllStarBids implements review and monitoring processes to reduce counterfeit risk. While authenticity cannot be guaranteed in all cases, enforcement actions may include listing removal, account suspension, or permanent bans.

15. Disclosure of User Information and Post-Auction Communication

In order to facilitate the successful completion of transactions conducted through the AllStarBids (allstarbids.com) platform, certain user information must be shared between the winning bidder (“Buyer”) and the seller (“Seller”).

By listing items for sale, placing bids, or participating in any auction on AllStarBids, you acknowledge and agree that, upon the successful completion of an auction and determination of a winning bid:

Information Shared Between Buyer and Seller

  • The Buyer and Seller will each be provided with the other party’s account username and/or registered business name, as applicable.

  • The Buyer’s shipping name and shipping address, as listed within the Buyer’s account profile, will be made available to the Seller for the purpose of fulfilling and delivering the purchased item.

  • Additional contact information associated with each party’s account may be made available where reasonably necessary to allow the parties to communicate regarding the completion of the transaction.

Post-Auction Communication

Upon completion of an auction and issuance of a transaction or settlement statement by AllStarBids confirming the auction results, the Buyer and Seller may contact one another directly for the sole purpose of completing the transaction.

Such communication may include, but is not limited to:

  • The Buyer notifying the Seller if the intended shipping destination differs from the shipping address contained within the Buyer’s account profile, and providing updated shipping instructions where applicable.

  • The Seller informing the Buyer of the forms of payment accepted by the Seller in order to complete the transaction.

  • Coordination regarding payment processing, shipping arrangements, delivery timing, and other reasonable steps necessary to fulfill the auction transaction.

This exchange of information and communication between parties is a necessary and integral part of completing transactions conducted through the AllStarBids auction marketplace.

By using the platform, you expressly acknowledge and consent to the disclosure of such information to the applicable transaction counterparty and to direct communication between parties for the purposes described above. If you do not agree to such disclosure and communication, you must not participate in auctions, place bids, list items for sale, or otherwise use the transactional features of the platform.

All users agree that any information shared through this process shall be used solely for the purpose of completing the relevant transaction and may not be used for unrelated, unauthorized, or unlawful purposes.

AllStarBids disclaims any responsibility or liability for the actions of Buyers or Sellers following the disclosure of such information where such disclosure is necessary to facilitate completion of the transaction.

Platform Role and Payment Handling Disclaimer

AllStarBids (allstarbids.com) operates solely as an online auction marketplace platform that allows independent users to list items, participate in auctions, and connect with other users for the purpose of buying and selling collectibles, memorabilia, and other permitted goods.

AllStarBids is not a party to any transaction between Buyers and Sellers. The platform does not take possession of listed items, does not inspect or verify items, and does not process, collect, hold, or distribute payments between Buyers and Sellers.

All payments for items purchased through auctions conducted on the platform are made directly between the Buyer and the Seller, outside of the AllStarBids.com platform, using payment methods mutually agreed upon by the parties.

Accordingly

  • AllStarBids does not guarantee payment from Buyers or delivery of items from Sellers.

  • AllStarBids does not control, manage, or supervise the payment arrangements agreed upon between Buyers and Sellers.

  • Buyers and Sellers are solely responsible for negotiating, arranging, and completing payment and shipping for any transaction resulting from an auction.

  • AllStarBids.com does not provide escrow, payment processing, shipping, authentication, or transaction settlement services, unless explicitly stated otherwise.

By using the platform, you acknowledge and agree that AllStarBids’ role is limited to providing the technological marketplace through which auctions may occur.

Limitation of Liability

AllStarBids shall not be responsible or liable for:

  • Payment disputes between Buyers and Sellers

  • Non-payment, chargebacks, or payment fraud

  • Failure to ship, delayed shipment, or lost packages

  • Misrepresentation of items, authenticity disputes, or condition disputes

  • Any losses, damages, or claims arising from transactions conducted between users

Users participate in auctions and transactions at their own risk and agree that AllStarBids.com shall not be held liable for disputes or damages arising from such transactions.

16. Binding Arbitration & Class Action Waiver

Agreement to Arbitrate

By accessing or using the services provided by AllStarBids, you agree that any dispute, claim, or controversy arising out of or relating to the platform, its services, or any transaction conducted through the platform shall be resolved exclusively through final and binding arbitration, rather than in court, except as expressly provided below.

This arbitration agreement applies to all claims, including but not limited to claims arising under contract, tort, fraud, misrepresentation, negligence, statutory law, or any other legal theory.

Informal Dispute Resolution Requirement

Before initiating arbitration, the user agrees to first attempt to resolve the dispute informally by providing written notice to AllStarBids describing the nature of the claim and the requested resolution.

Both parties agree to engage in good faith negotiations for at least thirty (30) days before initiating arbitration proceedings.

Arbitration Procedure

If the dispute cannot be resolved informally, the matter shall be submitted to binding arbitration administered by a recognized arbitration provider agreed upon by both parties.

The arbitration shall:

  • be conducted by a single neutral arbitrator

  • take place in the jurisdiction where AllStarBids is headquartered, unless otherwise required by law

  • be conducted confidentially

  • follow the applicable arbitration rules of the selected arbitration provider

The arbitrator shall have the authority to award only the same remedies available in court on an individual basis, consistent with these Terms.

Waiver of Jury Trial

By agreeing to arbitration, both parties knowingly and voluntarily waive the right to a trial by jury or to participate in a lawsuit in court, except for matters that may be brought in small claims court where applicable.

Class Action Waiver

To the fullest extent permitted by law, all disputes must be brought solely in an individual capacity.

Users agree not to bring or participate in any class action, class arbitration, representative action, or collective proceeding against AllStarBids.

The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.

Small Claims Exception

Notwithstanding the above, either party may bring an individual claim in small claims court if the matter qualifies under the applicable jurisdictional limits.

Arbitration Costs

Each party shall be responsible for its own legal fees unless the arbitrator determines otherwise in accordance with applicable law.

Arbitration costs and administrative fees shall be allocated according to the rules of the arbitration provider.

Governing Law

This arbitration agreement and any disputes arising out of or relating to the use of AllStarBids shall be governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law principles.

Severability

If any portion of this arbitration agreement is found unenforceable, the remaining provisions shall remain in full force and effect, except that if the class action waiver is deemed unenforceable, the entire arbitration provision shall be null and void.
